Terms of Use

These terms govern access to Charlevoix County Criminal History, a privately operated reference resource. Using the site means accepting the restrictions below, including limits on FCRA use, harassment, automated access, warranties, liability, and reliance on outside services.

NO FCRA USE. This private site has no affiliation with Charlevoix County, Michigan, or any government body. Neither the site nor its advertising partners offers a consumer report for credit, employment, tenant, insurance, or any other purpose regulated by the Fair Credit Reporting Act.

1. What This Website Is

This is an independent reference site. It does not store official criminal records, perform official checks, obtain records for users, or submit filings. It points readers toward Charlevoix County courts, the Sheriff and Jail, Michigan State Police ICHAT, MDOC OTIS, the Michigan Public Sex Offender Registry, and outside research tools.

2. Rules for Using This Site

By using the site, you agree not to:

  • Violate federal, Michigan, or local law
  • Harass, stalk, threaten, or harm another person
  • Use site content for an FCRA-regulated decision
  • Attempt unauthorized access to systems or data
  • Run bots, scrapers, or other automated tools against the pages
  • Interfere with site performance or another visitor's access

3. No Harassment, Stalking, or Discrimination

Information from this site or a linked service may not be used to intimidate, threaten, stalk, harass, or unlawfully discriminate against anyone. Michigan Public Sex Offender Registry information requires special care. MCL 28.728c governs public dissemination and misuse, and registry data exists for lawful public-safety awareness, not retaliation or vigilantism.

4. We Are Not a Consumer Reporting Agency

We do not prepare credit reports, background checks, or consumer reports and are not a consumer reporting agency under the FCRA. You must not use content or a linked tool to decide credit, employment, tenant screening, insurance eligibility, licensing, benefits, or any other FCRA-regulated matter. A lawful official check must use the channel required for its authorized purpose.

5. No Legal Advice

Information about Charlevoix County procedures and Michigan records law is general and not legal advice. It cannot determine how a charge, warrant, conviction, set-aside, or access rule applies to a person. Seek advice from a licensed Michigan attorney.

6. No Warranties

The site and all content are supplied “as is.” We do not warrant that information will always be accurate, current, complete, uninterrupted, secure, or error free. Nor do we guarantee an outside search result. Criminal records can change through new filings, corrections, dispositions, sealing, and set-asides. Only the originating office can make an official statement.

7. Third-Party Services and Links

Links may lead to government sites, courts, agencies, and outside search providers that we do not control. Their own terms, fees, privacy practices, availability, and content apply. We are not responsible for those services.

8. Intellectual Property

Unless otherwise identified, site text, graphics, logos, and code belong to Charlevoix County Criminal History or its content partners. They may not be copied, modified, distributed, or used to create derivative work without prior written permission.

9. Limits on Our Liability

To the fullest extent Michigan law permits, we are not liable for direct, indirect, incidental, consequential, or other damage tied to site use, inability to use the site, reliance on its content, or use of a linked service.

10. Indemnification

You agree to defend and hold us harmless from claims, demands, actions, losses, and reasonable costs arising from your use of the site or violation of these terms.

11. Governing Law

Michigan law governs these terms without regard to conflict-of-law rules. A dispute connected with site use must be brought in a court with proper jurisdiction in Michigan.

12. Changes to These Terms

These terms may be revised. An updated version becomes effective when it is posted on this page.

13. Cutting Off Access

Access may be suspended, limited, or ended at any time and without advance notice, including when use threatens the site, violates these terms, or harms others.

14. Severability

If a court finds one provision invalid or unenforceable, the remaining provisions continue in effect. The affected provision will be limited only as much as needed to make it enforceable.

15. Questions

Questions about these terms may be routed through the Contact page.
